Understanding Your Rights

What are road traffic accident claims?

A road traffic accident claim is a legal process that allows anyone injured on UK roads to recover compensation. We handle claims from minor incidents through to the most serious injury cases.

What you can claim for

You can claim for personal injury (pain & suffering), medical and rehabilitation costs, lost income, hire-car expenses, damaged property, and care provided by family members during recovery.

Can I claim if I was at fault?

Even if you were partly at fault, you may still recover compensation under the principle of contributory negligence. The award is reduced by the percentage of fault; for example, a 70/30 split pays 70% of damages.

Can I claim for stress or anxiety?

Yes. Psychological injuries,  including PTSD, depression and anxiety following a crash, are fully recoverable provided they are diagnosed and supported by medical evidence.

Injuries beyond whiplash, including back, psychiatric, limb and other injuries, are valued individually based on severity, medical evidence and your specific circumstances, using the Judicial College Guidelines. Because these vary significantly case by case and we could not confirm a single current, authoritative range for each category, we’ve left this section out rather than publish a figure we can’t stand behind. Speak to our team or try our Claim Value Estimator for guidance specific to your injury.

How do I claim for a road traffic accident?

Report the accident to the police if required, seek medical attention, gather evidence (photographs, witness details and dashcam footage) and contact a specialist solicitor for a free assessment. We handle the rest on a No Win No Fee basis.

Yes. Psychological injuries including PTSD, anxiety and depression are recoverable alongside physical injuries, provided they are diagnosed by a qualified medical professional.

You can claim for the market value of your vehicle, hire-car costs while you wait for replacement, and any personal belongings damaged in the accident, separately to your personal injury claim.

You typically have three years from the date of the accident  or from the date you became aware of the injury under the Limitation Act 1980. Claims for children run from their 18th birthday.

Simple whiplash claims processed via the Official Injury Claim portal often settle within 4 – 6 months. Cases involving serious injury or contested liability can take 12 – 18 months.

It depends on the type and severity of the injury. Whiplash injuries lasting under two years follow a statutory tariff (currently £275–£4,830, effective from 31 May 2025). Other injuries are valued individually using the Judicial College Guidelines. Try our Claim Value Estimator or speak to our team for guidance specific to your case.

Even if you were partly responsible, you may still be able to claim. Compensation can be adjusted to reflect shared responsibility, known as contributory negligence.

It helps, but it isn’t always required. Evidence such as photos, witness details, or dashcam footage can also support your case.

You may still be able to claim through the Motor Insurers’ Bureau, which exists to cover victims of uninsured or untraced drivers.

Most road traffic accident claims are settled without a court hearing. Our team will explain what to expect at each stage.

This depends on the severity of your injury, financial losses, and how the accident has affected your daily life. Try our Claim Value Estimator for an early indication.
