Can you claim for a neck injury?
You may be able to claim compensation for a neck injury if it happened in the last three years and was caused, at least in part, by someone else. That could be an employer who did not keep you safe at work, another driver, or an organisation responsible for a place where you were hurt.
Most neck injury claims are handled on a No Win No Fee basis. If your neck injury was whiplash from a road accident, you can read how those claims work on our whiplash claims page. If you are not sure whether you can claim, our team can check for you.
Neck injuries, from minor to serious
Neck injuries range widely, and so do neck injury claims. At the milder end are soft tissue injuries and whiplash, which usually settle over time. More serious injuries include fractured vertebrae, a herniated or prolapsed disc in the neck, and damage to the spinal cord, which can have lasting effects.
Where the accident was someone else’s fault, you may be entitled to compensation for the injury and for its effect on your work and daily life. Our solicitors handle neck injury claims of every severity and will explain where you stand.
is usually the time limit to start a neck injury claim, from the date of the accident, or from when you knew the injury was linked to it. Different rules apply for children. If you are unsure, we can check for you.
Common causes of neck injury claims
You may be eligible to claim if your neck injury was caused by another party’s negligence.
Accidents at work
Lifting heavy objects, falls, or poor workstation setup. Employers have a legal duty to protect you from these risks.
Road accidentsRoad accidents
A collision can strain or injure the neck. Whiplash is the most common; for road-accident whiplash.
Slips, falls and sport
A fall on an unsafe floor or pavement, or a sporting incident caused by someone else’s carelessness or poor conditions.
Neck injury claims can follow almost any of these. If someone else was at fault, tell us what happened and we will let you know where you stand.
How much compensation for a neck injury?
There is no single figure, because it depends on how serious the injury is and how long it affects you. Most neck injury claims are valued using the Judicial College Guidelines, which set guideline brackets for different severities.
Minor whiplash-type neck injuries from a road accident lasting up to two years are set by a fixed government tariff, not by these brackets.

| Moderate, ongoing symptoms or some permanent effect | about £8,000 to £25,000 |
| Severe, with significant permanent disability | about £25,000 to £65,000 |
| Most severe, extensive and permanent | up to about £148,000 |
Evidence that supports your claim
Clear evidence gives neck injury claims the best chance of success, by showing how the accident happened and how the injury has affected you. You do not need to gather everything before you get in touch. We can help.
Neck and back injured together? Many accidents affect both. We can handle a combined claim.

No Win No Fee neck injury claims
Neck injury claims can be funded on a No Win No Fee basis, so you can start without paying anything upfront. If your claim is unsuccessful, you will not pay a fee for our work, subject to the terms of your agreement.
If your claim succeeds, an agreed success fee is deducted from your compensation. Your solicitor will explain this clearly before you commit to anything. For serious injuries, an interim payment can sometimes be arranged before the claim ends, to help with immediate costs.
You will see the full terms in writing before your claim begins.
Frequently Asked Questions
Everything you need to know before starting your claim.
How much compensation can I get for a neck injury?
It depends on how serious the injury is and how long it affects you. The courts use the Judicial College Guidelines, which set guideline brackets from a few thousand pounds for a minor neck injury with full recovery up to tens of thousands, and higher for the most serious injuries with lasting disability. These are a guide, not a promise. Minor road-accident whiplash is set by a separate fixed tariff. Financial losses can be claimed on top.
Is whiplash a neck injury, and where do I claim for it?
Yes, whiplash is a common soft-tissue neck injury. If it was caused by a road accident, compensation is usually set by the fixed government tariff.
Can I claim for a neck injury at work?
Yes, if your employer failed in their duty to keep you reasonably safe and that led to your injury, for example through unsafe lifting or a poor workstation. You cannot be dismissed for making a genuine claim.
What about a slipped or herniated disc?
A disc injury in the neck (a cervical disc) is covered here. A slipped or herniated disc in the lower back is dealt with on our back injury page. If the accident affected both, we can handle a combined claim. Our team can point you to the right place.
Who pays my compensation?
Usually the insurer of the person or organisation at fault, such as an employer’s or a driver’s insurance. You are claiming against insurance, not an individual. If the injury was caused by a violent crime, a separate scheme called the Criminal Injuries Compensation Authority may apply, and we can advise on that.
How long do I have to make a claim?
In most cases you have three years from the date of the accident, or from when you realised the injury was linked to it. For children, the three years usually starts on their 18th birthday. Different rules apply for people who lack the capacity to claim. If you are unsure, contact us and we will check whether you are still in time.In most cases you have three years from the date of the accident, or from when you realised the injury was linked to it.
